ARIA Shape B — Terms, Refund Policy & Privacy

By subscribing to or using ARIA Shape B ("the Service"), you agree to the Terms of Service, Refund & Cancellation Policy, and Privacy Policy below. If you are entering into these terms on behalf of a company, you represent that you are authorized to bind that company.

1. Terms of Service Agreement

1.1 What ARIA Shape B is

ARIA Shape B is a behavioral testing and evaluation service for AI/LLM systems. You connect one or more of your own AI/ML model endpoints, and the Service runs behavioral tests against them — on demand and on a schedule you choose — and returns a score and a downloadable report.

1.2 Eligibility and your account

• You must provide accurate account information and keep it current.
• You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. We strongly recommend enabling multi-factor authentication (MFA).
• For company accounts, each user should have their own login; do not share a single login.

1.3 Your responsibilities and acceptable use

You agree that you will:

• Only connect endpoints you own or are authorized to test. You must not use the Service to test, probe, or attack any endpoint, system, or model that you do not own or have explicit permission to test.
• Provide your own AI/model provider API key(s) and bear your own provider/model usage costs. Tests are executed against your endpoint using the key you supply, so your provider bills you directly for that usage.
• Not use the Service for competitive benchmarking of the Service itself, scraping, reverse engineering, or attempting to derive or copy our testing methodology, test contents, or underlying software.
• Not resell, sublicense, or provide the Service to third parties without our written consent.
• Comply with all applicable laws and your own contractual and regulatory obligations.

1.4 Your API keys and credentials

When you connect an endpoint, you authorize us to use the API key or credential you provide solely to run the tests you request. Credentials are encrypted at rest; a breach of our stored data would yield unusable ciphertext, and credentials are decrypted only in memory at the time a test runs. We recommend you supply a scoped, spend-limited, revocable key, and you may rotate or revoke it at any time from your account.

1.5 Fees, billing, and taxes

• The Service is a paid subscription, priced per connected model per month, billed in advance and renewing automatically until cancelled.
• Applicable sales tax or VAT is added at checkout. Payments are processed by our payment provider, Stripe.
• Prices may change on renewal; we will give reasonable notice of any change before it takes effect.

1.6 No warranty

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including without limitation any implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or uninterrupted or error-free operation. We do not warrant that the Service will detect all issues in your AI systems or that results are complete or accurate.

1.7 Limitation of liability

To the maximum extent permitted by law, Aggi Technologies LLC will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business, or goodwill, arising out of or relating to the Service or these terms, even if advised of the possibility of such damages. In particular, we are not liable for the behavior of your AI systems or for any business loss resulting from an issue the Service did not detect. Our total aggregate liability for any claim will not exceed the amount you paid us for the Service in the three (3) months preceding the event giving rise to the claim.

1.8 Indemnification

You agree to indemnify and hold harmless Aggi Technologies LLC from any claims, damages, liabilities, and expenses arising from your misuse of the Service, your violation of these terms, or your testing of endpoints you do not own or are not authorized to test.

1.9 Suspension and termination

We may suspend or terminate access for breach of these terms, non-payment, or suspected abuse or unlawful use. You may cancel at any time (see the Refund & Cancellation Policy). Sections that by their nature should survive termination (including 1.6–1.8) will survive.

1.10 Changes to the Service and to these terms

We may update the Service and these terms from time to time. Material changes will be posted on this page with an updated "Last updated" date; continued use after changes take effect constitutes acceptance.

1.11 Governing law

These terms are governed by the laws of the State of Texas, USA, without regard to conflict-of-laws rules. The parties submit to the exclusive jurisdiction of the state and federal courts located in Texas for any dispute not otherwise subject to arbitration.

2. Refund & Cancellation Policy 7-day guarantee

2.1 Cancelling after the 7-day window

• Monthly plans: you may cancel at any time. Your subscription remains active until the end of the current paid month, after which it does not renew. Payment for the current month is non-refundable.
• Annual or multi-year plans: on cancellation, we refund the unused whole months remaining in your term (the current month is non-refundable), and the subscription then ends.

2.2 How to cancel

Cancel through the billing/customer portal linked from your account, or contact us at support@aggicorp.com. Refunds are issued to your original payment method via Stripe and may take several business days to appear.

2.3 Notes

• Provider/model usage costs billed to you by your own AI provider are not part of your Aggi subscription and are not refundable by us.
• Nothing in this policy limits any non-waivable statutory rights you may have under applicable law.

3. Privacy Policy Your data

3.1 What we collect

• Account information: your name, email address, and (optionally) business name and billing address.
• Endpoint configuration: the endpoint URL(s) you connect and the API credential you provide (stored encrypted — see 3.3).
• Billing information: handled by our payment processor, Stripe. We do not store your card or bank details on our servers.
• Usage and results: your test schedule, the resulting scores, and timestamps.

3.2 How test content is handled — we do not keep your prompts or responses

When a test runs, we send test inputs to your endpoint using your key. We do not retain the raw test prompts or your model's raw responses beyond the run. After a test is scored, that raw content is discarded. We keep only the derived score and timestamp so you can see your trend.

This applies to your test content only. Your connection credential (the API key you provide) is handled differently: because your tests run automatically on a schedule, we do store that credential — encrypted at rest — so we can run your scheduled tests without you being present. See section 3.3 for how it is protected.

3.3 How we protect your data

Credentials are encrypted at rest using envelope encryption; the key needed to decrypt them is held separately, so a breach of our database alone would not expose usable credentials. Credentials are decrypted only in memory, only to run your tests, and are never displayed back to you or logged. You may rotate or revoke your key at any time.

3.4 How we use your data

We use your data to provide and operate the Service, process payments, communicate with you about your account, provide support, and comply with legal obligations. We do not sell your personal data.

3.5 Who we share with

We share data only with service providers who help us operate the Service, such as our payment processor (Stripe) and our hosting/infrastructure providers, and only as needed to provide the Service, or where required by law.

3.6 Data retention and deletion

We retain account and score data for as long as your account is active. If your subscription lapses or you close your account, we suspend and then delete your account data after a reasonable retention period, and we destroy the stored (encrypted) credentials. You may request access to, correction of, or deletion of your personal data (see 3.7).

3.7 Your rights

Depending on your location (including under the GDPR and CCPA/CPRA where applicable), you may have rights to access, correct, delete, or port your personal data, and to object to or restrict certain processing. To exercise these rights, contact us at support@aggicorp.com.

3.8 Cookies

We use only the cookies necessary to operate the Service (for example, to keep you signed in) and standard, privacy-respecting analytics to understand site usage. We do not use advertising cookies.
